GCA 6141 <br /> Master Agreement for Transportation Demand Management Work by King County <br /> EXHIBIT A <br /> Federal Transit Administration Provisions <br /> Section 1 <br /> General <br /> The COUNTY agrees to include these provisions in each subcontract financed in whole or in <br /> part with Federal assistance provided by Federal Transit Administration (FTA) and in all <br /> contracts it enters into for the employment of any individuals, procurement of any materials, or <br /> the performance of any Work under this Task Order. It is further agreed that these clauses <br /> shall not be modified, except to identify the subcontractor or other person or entity that will be <br /> subject to its provisions. In addition, the following provision shall be included in any <br /> advertisement or invitation to bid for any procurement by the COUNTY under this Task Order: <br /> Statement of Financial Assistance - <br /> This Agreement is subject to a financial assistance contract between the Washington State • <br /> Department of Transportation and the Federal Transit Administration and the appropriations of <br /> the State of Washington. <br /> Section 2 <br /> Procurement <br /> The COUNTY shall make purchases of any incidental goods, essential supplies, or Project <br /> Equipment pursuant to this Task Order through procurement procedures approved in advance <br /> by the STATE and consistent with the following provisions: <br /> A. General Procurement Requirements. The COUNTY shall comply with third party • <br /> procurement requirements of 49 U.S.C. chapter 53 and other applicable Federal Laws in effect <br /> now or as subsequently enacted; with U.S. Department of Transportation (DOT) third party <br /> procurement regulations of 49 C.F.R. § 18.36 and other applicable Federal Regulations <br /> pertaining to third party procurements and subsequent amendments thereto. The COUNTY shall <br /> also comply with the provisions of FTA Circular 4220.1.F, "Third Party Contracting <br /> Requirements," November 1, 2008, and any later revision thereto, except to the extent FTA <br /> determines otherwise in writing, which by this reference are incorporated herein; and any <br /> reference therein to "Grantee" shall mean COUNTY. The COUNTY agrees that it may not use <br /> FTA assistance to support its third party procurements unless there is satisfactory compliance <br /> with Federal laws and regulations. <br /> B. Full and Open Competition. In accordance with 49 U.S.C. § 5325(a), the COUNTY agrees <br /> to conduct all procurement transactions in a manner that provides full and open competition as <br /> determined by FTA. <br /> C. Exclusionary or Discriminatory Specifications. Apart from inconsistent requirements <br /> imposed by Federal laws or regulations, the COUNTY agrees to comply with the requirements <br /> of 49 U.S.C. § 5325(h) by not expending or otherwise using any Federal assistance awarded to <br /> support a procurement using exclusionary or discriminatory specifications. <br /> D. Preference for United States Products and Services.
