Roberts: <br />I am the attorney for Ptichael Berman, �aho is the holder of a <br />promissory note executed by Keith Cryer, and �ahich is secured by <br />a deed of trust against the above property. P1r. I'ryer has <br />defaulted on the note and deed oE trust, �aent and filed bankrutpcy <br />and otherwise caused my client grief with regard to this property. <br />We have obtained the permission of the bankruptcy court to go <br />ahead with the foreclosure against the property. <br />The order was signed by the court on September 9, 1992, and the <br />foreclosure was started by the issuance and service of a notice of <br />default dated September 11, 1992. The next step will be the <br />recording and service of a notice of Crustee's sale, �vith a sale <br />date in late January or early February, assuming all goes on <br />schedule. <br />My client is aware of the Notice and Order by the City ot <br />Everett of January 24, 1992 regarding the property. Mr. Fryer <br />obtained an extension to June 21� 19°2, and actually had a <br />contractor start work. The house now is a shell basically, <br />and then he filed bankruptcy and the contractor walked away, <br />�ahich is understandable since he saas not paid and Ptr. �ryer <br />filed bankruptcy in P1ay. <br />P1y client is willing to cure the problem iaith regard to the <br />house by causing its removal or demolition or repair, but as a <br />secured party onl}• at this point is not in a position to do so. <br />I would request the patience of your office and that you take <br />no action against the property to remove or demolish the house <br />and give my client the opportunity to complete the foreclosure <br />and then deal with it .s owner. I expect him to be the owner <br />as there is much more owed against the house than it is worth <br />at this time in its current conciition, and no one else is likely <br />to tid at the sale. <br />My client desires to cooperate fully �vith your office, and if a <br />representative of your office would like to speak with him, <br />� <br />�; <br />� <br />
