/EAL PROPERTY
February 25, 2002
Mr. Craig M. Chapman
Chapman Truck Inc.
3821 Railway Ave. /
Everett, Washington 98201
SUBJECT: Right of Way Use at 3821 Railway Ave.
Dear Mr. Chapman:
I am sorry to hear of the passing of your father, and realize the timing of our action
probably appears suspect to someone just assuming the burden of managing a property
that has been in the family for a long time, and may not have been aware that a problem
existed. However, I have been through the City's files regarding the site, and find no
record of any discussions regarding the right of way in 1968. Lacking some evidence
binding the City to out of the ordinary" obligations or commitments, I am required to
enforce the current codes and policies of the City.
Since its incorporation, the City has historically improved rights of way by either fortning
Local Improvement Districts and assessing the benefited properties, or, in cases of a
more regional improvements, approving Bonds, bu! under "normal circumstances" it has
never been a function of the General Fund to provide properties with access.
If you have documented evidence to support your agreement with the City I need a copy
for our files to prevent this misunderstanding from surfacing again in five or ten years.
Otherwise, you must comply with the requirements of the February 5"' letter to your
mother.
If you have any further questions regarding this matter please call me at 257-8800.
Sincerely,
- — - T
Lon Mayberry
Real Property
CITY OF EVERETT • 3200 Cedar Street • Everett, WA 98201 •(425) 257-8800 • Fax (425) 257•8856
