Eric Hopkins <br /> 1323 Oakes <br /> Everett, NA g82ot <br /> hereinafter referred to as "Applicant," for a variance from E.M.C. <br /> 19.16.050(B) , Side Yard, to allow: <br /> demolition of an existing nonconforming garage and construction of a <br /> new garage on the same site. The exiating nonconforming garage i� <br /> three feet from the south side property line rather than the five <br /> feet required by Code and the new garage will be built on the same <br /> footprint except it will be extended five feet in length. <br /> on the following described property <br /> The south 6 feet of Lot 11. all of Lot 12, and the north 10 feeL of <br /> Lot 13. Block 24g, Plat of Fourteenth Street Addition <br /> commonly known as: 1323 Oekes <br /> 1 <br /> The Board of Ad�ustment. following a public hearing on said application held <br /> on July 6. 1987 and further having reviewed all teatiapny, mekee the <br /> follouing Finding�, Conclusion� and Order: <br /> E'INDINGS AND CONCLUSIONS: <br /> 1. That there have been exceptional or extraordinary circumstances or <br /> conditiona applying to the sub�ect property or as to the intended uae � <br /> thereof that do not apply generally to other propertiee in the same <br /> vicinity or zone. � <br /> �� Finding: The existing garage, looated on a 41—foot—wide lot, was <br /> built Sn the 1920�s and ia too short to acaommodate two vehicles. In <br /> � order to provide adequate offatreet storege and proteotion for his <br /> vehicles� the app'_icant would like to dertalish the exi�ting 79 ft. x <br /> I 20 ft. atrunture and replaee it with a 24 ft. x 20 ft. structure. <br /> The ne►r structure would abut the rear property line. <br /> Concluaion: Considering the inedequaoy of the older atructure to <br /> meet prexnt off.atreet parking needs, this request seems reasonable. <br /> 2. That such variance ie neaessary for the preaervation and en�oyment of <br /> a substantial property right of the appellant posaeeaed by the or+nera <br /> of other propertie� in the same vicinity or zone. <br /> Finding: The City encourages property owners to provide garages in <br /> order to meet off—atreet parking requirements. The applicant�s <br /> property ha� had a nonconforming garage exi�ting 3 feet lYom the <br /> property line since the 1g20's. <br /> Conclusion: The variance would allow a property right which has <br /> been en�oyed by the applicant and by other properties in the area. <br /> 3. That the authorization of auch variance will not be materially <br /> detrimental to the public welfare or in�uriou� to property in the <br /> vicinity or zone in which the property is located. <br /> Finding: No adverse comments were received fl�om other Clty <br /> Departments. Since the new structure would retain the existing <br /> 3 foot setback tY�om the south side property line. the owner would be <br /> able to provide adequate maintenance of the structure. Moreover. <br /> replacement of the present dete�iorating structure will improve the <br /> appearance oF the neighborhood. <br />
