According to Snohomish County Assessor's records each of the residences <br /> was constructed prior to December 1, 1956. <br /> The maximum densiry within an R-2 zone is one single-family residence per 4,500 <br /> square foot lot, or a duplex on a 7,500 square foot lot. This site is deveioped with three <br /> independent single family residences. <br /> In addition to the nonconforming use cn site, the residences fail to meet setback <br /> requirements for living space. Both 1613 and 1615 appear to be located within the rear <br /> yard setback and encroach into the north interior side setback. 1617 Oakes appears to <br /> be located within the front setback. The site may also fail to comply with the off street <br /> parking requirement. <br /> The large house (1617 Oakes) was converted into a duplex after December 1956. The <br /> basement unit is not legal and must be removed and brought into conformance. All <br /> structures on site are recognized and certified as single family residences. <br /> Refer to the attached site plan, provided by the property owner, for information regarding <br /> specific building setbacks, building lieight, and building dimensions. <br /> Decision: I hereby find that the use and setbacks for the above structure(s) are <br /> recognized as legal non-conforming and meet the City of Everett Zoning Code in effect <br /> at the time of construction. This certification is subject to revocation if it is found that the <br /> information upon which this decision was based is erroneous. The applicant is still <br /> responsible for determining whether there are any additional City, State, or Federal <br /> permit requirements for any proposed building construction or remodel on site. <br /> u�6, 2002 <br /> Paul A.
