FINDINGS AND DECISION <br />OF THE HEARING EXAMINER OF THE <br />CITY OF EVERETT <br />IN THE MATTER OF THE APPEAL <br />OF MIKE ELKE <br />APPEAL t#01-006 <br />DECISION: The appeal is granted, and the October 1, 2001, <br />denial of a building permit application is <br />remanded for processing. <br />INTRODUCTION <br />On October 1, 2001, the City of cverett (City) denied a building permit for a 1,796 <br />square foot building on property at 5027 Ocean Avenue, Everett, Washington <br />(subject property). The building was projected to have a 476 square foot apartment <br />and an attached 1,320 square foot garage. The City denied the building permit <br />because the principal use of the structure would be as a garage, which is contrary to <br />provisions of the Everett Municipal Code that requires g�rages to be accessory <br />structures. On October 15, 2001, Mike Elke, 5039 Ocean Avenue, Everett, <br />Washington, (Appellant) appealed the City's determination. <br />A hearing on the appeal was held before the Hearing Examiner of the City of Everett <br />on December 6, 2001.
