<br />referred to as "Owner;' owns certain property within the City of',Everett legally

<br />W HGREAS, Owner has applied for a permit from the City of Everett which
<br />under Orciinance 555-78 and subsequent amendments thereto require certain improve-
<br />ments to be made to public rights of wa� as a condition to issuanee of certain City
<br />permits; ;aid Ordinances allow that the Ci.ty Engineer may accept a covenant consenting
<br />to the torrnation of a local improvement district in lieu of having Owner construct
<br />and install the required public improvements.
<br />WH[REAS, Owner's property and the adjacent public rights of way have
<br />becn determined to require a covenant consenting to the formation of a local improve-
<br />mcnt district rather than having Owner make specific improvements.
<br />NOW, THEREFORE, in consideration of issuance of applie.able City permit(s)
<br />pursuant to Ordinance No. 555-78 and subsequent amendments tFiereto and in lieu
