EASEIVI�NT <br /> Beginning at the southeast corner of that certain Parcel No.2 as conveyed to the City of <br /> Everett on November 10, 1900 by Saint Paul,Minneapolis and Manitoba Railway Company, <br /> by deed on file with the Everett City Clerk's Office;Thence westerly along the south line of <br /> said Parcel No. 2 for a distance of 15 feet;Thence angle right at 90 degrees for a distance of <br /> 15 feet;Thence angle right at 90 degrees for a distance of 25 feet more or less to intersect <br /> the east line of said Parcel No.2; Thence southwesterly along the east line of said Parcel IVo. <br /> 2 to the Point of Beginning. <br /> This easement is granted subject to and conditioned upon the following terms, conditions and <br /> covenants: <br /> 1. Grantee shall at all times conduct its nctivities and all other acti��ities conducted on <br /> City's property so as not to interfere wiUy obstruct or endanger the usefulness of any of the <br /> City's improvements, or oU�er facilities, now or hereafter located on City's property, or 'n any <br /> way interfere with,obstruct or endanger the City's use of the parcel. <br /> 2. Prior to any construction, work or any other activity by Grantee within thc easement, <br /> notification and plans for the same shall be submitted in writing to the City by Grantee and no <br /> such construction, work or activity by Grantee shall be commenced without Cirj's prior written <br /> agrcement that the Grantee's proposed construction, work or activity will not interfere with the <br /> City's ability to use the remainder of the parcel herein described; The City's revicw of the <br /> Grantor's plans under this easement shall not be deemed to impose any duty or obligation on the <br /> City to determine the adequacy or sufficiency of Grantee's plans and designs nor whether <br /> Grantee's construction, �vork or activity is in conformance with other applicable plans, codes and <br /> regulations. Purther, agreement by the City to such construction, work or activity shall not in <br /> any manner be considered as imposing any obligation, duty or liability upon the City as to the <br /> safety or propriety of such construction,work or acfivity. <br /> 3. In the event Grantee places any improvements on or in the easement or constructs <br /> anything within the easement without first having obtained the written approval of the City <br /> 2 <br />
