Soil at these
construction projects may contain elevated concentrations of azsenic. Excavation ofthis soil could
cesult in the generation of state dangerous wute. In an effort to minimize the chance that soil,
potentially classified as dangerous waste, is handled and transported improperly, I am requesting that
the City include a condition on any building permit for constrvction projects conducted on the Everett
Smelter site (see attached map). Any consUuction projects that will require the movement or
disturbance of soil should contain ihe following condition:
Representative soil samples must be collected and analyzed for total usenic content. Only
soil that will be disturbed should be sampled. The aumber of samples necessary will depend
on the amount of soil that will be disturbed. Soil samples should be collered-and analyzed in
accordance with standazd environmental laboratory procedures. Results of the analysis must
e reporc to e City of Everett Public Works Deputment and the Deoartrnent of Ecolo
Tozia Cleanup Program, Northwest Regional Office Any excavated soil s6a11 be hand e['a J'9
and dispos ance'wtdi'atty'1iL'2btSTaws or regulations (eg. soii classified as S' ',p
dangerous wazte shall be handlecl and d•.sposed of in accordance witlt Chapter 17 3-3 0 3 W A C,o'oo,
the Dangerous Waste Regulations). In addition, adequate precautions must be taken to insure,o o
that any disrurbed soil daes not>ose a potential threat to human health and the environment .oe^xs
during or after the construction project. Compliance with this condition does not alter the 9c j s
persoa's obligatiun to comply with all other applicable laws or regulations. `y
In addition to the above condition, I recommend that a copy of the Snohomish Health District's Public
Healty•Advisory be attached to any building permit issued for projects within the smeiter site study
azea. -
Per your request, I have included a msp showing the general azea where any building permits should '
contain this condition. I have also inciuded a list of environmental laboratories'where soil samples
could be analyzed. This list is only iduded u a starting point for anyone interested in having soil
.,;e. 0
