Tillotson <br /> 620 112th St. S.E. ,Sp. <br /> Everett <br /> hereinafter referred to as "Applicant," for a variance from <br /> E.M.C.19.16 030, Minimum Lot Width, to allow a iot width of 40 <br /> feet instead of 50 feet as required by code in order to allow a <br /> boundary line adjustment of a parcel consisting of four lots. <br /> There is an existing house (2005 Melvin Avenue) situated on Lots <br /> 33 and 34 and sliqhtly encroaching on Lots 35 and 36. The <br /> applicant wishes to adjust the lot line between Lots 34 and 35 in <br /> order to make Lots 35 and 36 a separate 5,000 square foot lot <br /> which would allow construction of a sinqle family residence. <br /> on the following described property: <br /> Lots 33,34 ,35, and 36, Block i , Plat of Pinehurst. <br /> commonly known as: 2005 ![�lvin <br /> The Board of Adjustment, followinq a public hearinq on said <br /> application held on June 6, 1988 and further havinq reviewed all <br /> testimony, makes the followinq Findings, Conclusions and Order: <br /> F711DIIiG3 AND CONCLUSIONS: <br /> Criterion Ilo. i- <br /> That there have been exceptional or extraordinary circumstances <br /> or conditions applying to the subject property or as to the in- <br /> tended use thereof that do not apply generally to other <br /> properties in the same vicinity or zone. <br /> a. Findina: The zoninq in this area is R-2, which requires <br /> a minimwn of 5,000 square feet of lot area and 50 feet of <br /> lot width for a single family structure. <br /> The subject property consists of four 25 foot by 120 foot <br /> lots which have sufficient area and width for two sinqle <br /> family lots; :�uwever, there is an existing single family <br /> structure on t.hF- site which encroaches into the required <br /> lot width for the eastern parcel (see Exhibit 2) . <br /> The Applicar.t is requesting a variance to allow 40 feet <br /> of lot widt'� for the parcel consistinq of Lots 35 and 36. <br /> If the variance is granted, he will proceed with a <br /> Boundary Line Adjustment to create two lots. One of the <br /> lots (Lots 35 and 36) will be 5010 square feet in area <br /> and the other (Lots 34 and 35) will be 6,990 square feet <br /> in area. <br /> b. Conclusion: There area unusual circumstances applying to <br /> this property that do not apply qenerally to other <br /> properties in the vicinity and aone since the site is <br /> larqe enough for two single family lots and could by used <br /> as such except for the location of the existing <br /> structure. <br /> Criterion No. 2: <br /> That such variance is necessary for the preservation e;n3 en- <br /> joyment of a substantial property rigrit of the appellant post <br /> sessed by the owners of other properties in the same vicinity or <br /> zone. <br />
