I have reviewed with them the issues surrounding the installa�ion by you of a swimming pool, ecology blocks, and a deck in your backyard as that relates to and affects your retaining wall which abuts the Ervines ' backyard at the western most portion of their property. ��.� As I understand it the retaining wall is leaning and has commenced to lean more as the result of the installation of your swimming pool and the construction surrounding that. The Ervines �� have already expressed their extreme concerr� to you with regard to the retaining wall and the obvious safety issues involved with its potential collapse. ,.�� As Z understand it your partner, Gil Davis, spoke with Gerry Ervine (on numerous occasions apparently) in an effort to resolve this matter. One oE Gil Davis ' request was that you be allowed ( �� to put support beams onto the Ervine property supporting the wall. Gerry indicated that that would be fine if and only if the following conditionc were met: �� 1) That there be a written agreement entered into between the Ervines and _vourself concerning the wall and what was to be done with it. �`� 2) That the support beams would be temporary only until the wall was stabilized and straightened out. :
