EASEMENT <br /> This easement is granted subject to and conditioned upon the followine terms, covditions and <br /> covenants: <br /> 1. Grantor shall at all tunes conduct its acrvities and all other activities conducted on <br /> Grantor's property so as not to interfere with, obstruct or endanser the usefulness of an}� <br /> imprcvements, or other facilities, now or hereafter maintained upon .�:� easement, or in any <br /> way interfere with, obstruct or endanger the Ciry's use of the easement. <br /> 2. Prior to any construction, work or any other activiry by �: .or within the easement, <br /> notification and plar., for the same shall be submitted in writing to the City by Grantor and no <br /> such construction, work or activity by Grant��r shall be commenced without City's prior <br /> written agreement ttat the Grantor's proposed construction, work or activity wil! not interfere <br /> with the City's easement granted herein; PROVIDED, HOWEVER, :.ay changes or revisions <br /> in the plons shall also be subject to City's prior agreement. The City's review of the Grantor's <br /> plans under this,easement shall not be deemed to impose any duty or obligation on the City to <br /> determine the adequacy or sufficiency of Grantor's plans and designs nor whether Grantor's <br /> construction, work or activity is in conformance with other applicable plar,�, codes and <br /> regutations. Further, agreement by the City to such cunstruction, wor}: or activity shail not in <br /> any manner be considered as imposing any obligation, duty or liability upon the Ciry as to the <br /> safety or propriery of such construction, work or activity. . <br /> 3. Grantor hereby authorizes City to cut, trnn and remove any and al] brush, trees, <br /> other vegetation or debris upun the easement and the right of access for such purposes. <br /> Grantor also authorizes the Ciry to cut, uim and remove any and all brush, trees, otner <br /> vegetation and debris on Grantor's property which, in the City's reasonaule judgment, <br /> constin:tcs a ha�ard to the easement and the right of access for such purposes. <br /> , <br /> AF24 � � O� Y80306 �� <br />
