A Nxtionat Pollutant Discharge Elimination System (NPDES) permit, administered by <br /> the US Environmental Protection Agency and/or Washington State Department of <br /> Ecology, will be req�ired for clearing and grading activities on this site if the site area <br /> disturbed by land alteradon activities �s greater than or equal to 5 acres. <br /> 3. A Notice of Construction must be obtained from the Puget Sound Air Pollution Control <br /> Agency. <br /> MITIGATION OF ADVERSE IMPACTS BY SEPA <br /> 1. The approved site plan associated with SEPA No. 491 is superceded by this approval. <br /> To the extent that changes to the site plan on Lot 2E of Seaway Center generate <br /> conflicts with the SEPA No. 4-91 site plan as applie� to other lots in Seaway Center, <br /> those conflicdng aspects of the SEPA No. 4-91 site plan are Null and Void. Prior to <br /> final approval of this MDNS, the Responsible O�cial must receive written acceptance <br /> of this condition from by representatives of all owners of interest in the Seawxy Center <br /> lou covered under SEPA No. 4-91. (SEPA Land and Shoreline Use Policies.) <br /> 2. Any grading/fill on this site shall be done so as to not impact the surrounding <br /> properties. (SEPA Earth, Land and Shoreline Use Policies.) <br /> 3. A tra�c study must be submitted before building permits are issued to determine trip <br /> generation, driveway sight distance, and driveway locations. If relocation of the <br /> driveways results in a significant re-design of the s�te, additional SEPA review may be <br /> requ'ved. (SEPA Transporcation Policies) <br /> 4. Shued driveways are required with adjacent properties unless topography or serious <br /> operational difficuldes make shared driveways mfeasible. Access easements from the <br /> Cintas driveways to Lots 2D and 2F must be provided in locations approved by the <br /> City Engineer. (SEPA Transportation Policies) <br /> 5. A transportation demand management program must be approved and in place before <br /> occupancy will be granted. (SEPA Transportation Policies) <br /> 6. A transit information display in the lobby/entrance area, or other cenUal location is <br /> required. This display must provide transtt schedules, car/vanpool information and a <br /> list of ridematch serv�ce phone numbers. (SEPA Transportation Policies) <br /> � Previous approvals called for routing a small flow of water into the native growth areas <br /> at the rear (western portion) of the site. The quantity of flow and discharge location(s) <br /> must be chosen to ensure that erosion of natural areas wili not occur becween the <br /> dischazge point and the main branc:h of Powder Mill. Appropriate downstrcam analysis <br /> wiil be reyu�red to demonstrate that this requirement is being met. The analysis must <br /> be reviewed and approved by the City prior to issuance of construction perm�ts. <br /> (SEPA Water and Earth Pol►cies) <br /> 8. Provided the peak sewer discharge rate is limited to the 0.34 cfs indicated in the March <br /> 15, 1994, Barghausen Engineering, Inc. letter, the existing sewer s�stem can <br /> accommodate the required sewer flow. However, this water intensive use wasn't <br /> anticipated when the sewer system was designeci for the area. Therefore, the balance <br /> of ihe Seawa� Center site will need to be developed with a sewer usage consistent with <br /> the design cntena of 4,000 gallons per acre per day.
