4. <br />I <br />POWER OF ATTORNEY <br />WHEREAS, Ordinance No. 555-78 was enacted to reduce the adverse effect <br />of increased vehicle and pedestrian traffic on existing neighborhoods and . <br />provide safe and efficient facilities for vehicle and pedestrian traffic, and <br />WHEREAS, Ordinance No. 555-78 requires, in part, a developer to improve <br />street and alley rights -of -way; or at the discretion of the City Engineer, a <br />developer may convey and execute in the favor of the City of Everett an <br />irrevocable power of attorney for the sole purpose of casting a voter signing <br />a petition or otherwise assenting to the formation of a Local Improvement <br />District. <br />NOW, THEREFORE, in consideration of issuance of a building permit, <br />pursuant to Ordinance No. 555-78 and in lieu of certain required street and/or <br />alley improvements, Craig Bunney Construction, Inc. <br />(hereinafter <br />referred to as "Developer"), and pursuant to Ordinance No. 555-78, has made, <br />constituted and appointed and by these presents does make, constitute and <br />appoint the City as true and lawful attorney for it and in its name, place <br />and stead, and as an irrevocable proxy to cast a vote for approval, by <br />petition or otherwise, of any Local Improvement District hereafter formed by <br />the City2231 Mos cesoe Aor or other property nroners in a benefit area encompassing <br />for ultimate street and related improvements pursuant to Ordinance No. 555-78, <br />as it presently exists or is hereafter amended or supplanted. <br />This power of attorney shall be a conveyance of an irrevocable interest <br />in and the Developer does by these presents convey to the City such limited <br />interest in the following described land, to wit: <br />Lots 30, 31, 32, of Plat of Pinehurst, Division B. <br />This power of attorney shall be a covenant to run with the fee titlo <br />to the above -described land perpetually; PROVIDED: The City of Everett shall <br />deliver a signed release of this power of attorney after installation of the <br />ultimate improvements shall ave been completed. <br />IN WITNESS WHEREOF, the Developer has hereunto set its hand and seals <br />this day of , 197 <br />STATE OF WASHINGTON ) <br />ss. <br />County of S►�o}iput �s <br />On this day personally appeared before me <br />me known to be the individual described in and who executed the within and <br />foregoing instrument and acknowledged that he/tkea► signed the same as his/fi <br />free and voluntary act and deed for the uses and purposes therein mentioned <br />GIVEN under my hand any, official seal thisZ42y . f �vCti 11 Ste, <br />1979. <br />- <br />(Ysi\ <br />NOTARY- PU SLIC in and for the ::thtx-' , <br />of Washington, residing at.
