JUL 03 1985 <br />BOARD OF ADJUSTMENT ...... . ..................................................... <br />FINDINGS, CONCLUSIONS AND ORDER CITY OF EVERETT <br />(Variance G12-85) Puh'ic Works Dec;. <br />July 2, 1985 <br />Based upon the written request for a variance from the City's zoning <br />code, specifically 19.16.050(B), made by George Garvell at 2518 Monroe Avenue, <br />hereinafter referred to as "Applicant", the Board of Adjustment, following a <br />public hearing on said application held on July, 1 1985, 1985, and further <br />having reviewed all testimony, makes the following Findings, Conclusions, and <br />Order: <br />FINDINGS AND CONCLUSIONS: <br />1. That there have been exceptional or extraordinary circumstances or <br />conditions applying to the subject property or as to the intended use <br />thereof that do not apply generally to other properties in the same <br />vicinity or zone. <br />Finding: The lot is 62 feet 6 inches x 115 feet. The existing garage <br />sets one foot from the side property line. The applicant is proposing <br />to rebuild at the same location. If allowed to rebuild, it would <br />require that the applicant be on adjacent property for construction. <br />Conclusion: Staff has not supported side setback requirements less <br />than three feet unless the applicant has an easement from adjacent <br />property. <br />2. That such variance is necessary for the preservation and enjoyment of a <br />substantial property right of the appellant possessed by the owners of <br />other properties in the same vicinity or zone. <br />Finding: Most accessory buildings that are in the older platted areas <br />of Everett don't maintain sideyard setbacks, however, they are adjacent <br />to other accessory buildings and take access off of alleys. <br />Conclusion_: This accessory structure is not consistent with other <br />structures in older platted areas which take access off of alleys. <br />3. That the authorization of such variance will not be materially <br />detrimental to the public welfare or injurious to property in the <br />vicinity or zone in which the property is located. <br />Finding: The existing structure sets next to a principal structure on <br />the adjacent property.
