As I have indicated, we have been <br />monitoring the backyard all throughout the winter in ordcr to help determine what thc <br />best course of action would be to help eliminate any ponding that may occur in your <br />backyard. After several investigations Uy our staff throughout the past few months, we <br />were not able to discover an instance where the ponding had occurred as it had done <br />the prcvious winter. This winter did contain some unusually severe rainfall events. On <br />December 2"� and 3"', 2007, the City experienced a]00 year, 24 hour rainfall event. <br />We had an inspector visit the site immediately after this event and he did not dctect the <br />ponding that had occurred previously. Our visits to the site and nvestigations has not <br />givcn us a clear undcrstanding of why this area pond� previousl� and docs not seem to <br />Uc doing so now. <br />I have reviewed this issue with City staff to see what the Ciry could do to assist you <br />with this siwation. Thc City would not bc inclined to go onto the site and perform any <br />conswction work on your ��rivate property. Any acmal construction on the site would <br />nced to be perfornud by you as thc owncr of the property. The Ciry ccvld not go on to <br />your property and perform any filling or exaction or pipc laying work <br />We liavc also given some consideration �vith regards to potential futur�: development of <br />your property in additional lots. �nd whcthcr or not the City would reg,ard this area as a <br />wedand that would impede d�c �reation of additional lots. Based o.n our observation <br />and this particular situation and given the conditions that presendy ex�st on the site we <br />would not consider this as a wcUand.
