�' II r1 "' <br />II <br />BOAAD OF ADJU3TM3NT <br />FINDINf3S� CONCLQSIONS AND ORDSR <br />(Variar,ca i2-86) <br />February 5� 1986 <br />Hased upon the written request for a varianea from the Cit�'s zoning <br />code, specifically 19•14.050, made by Mr. 8 Mrs. Quarterman at 4010 Nassau <br />Place� hereinafter referred to as "Applicant�" the Hoard of Adjustment� <br />following a public hearing on said application held on March 3r 1986, and <br />further having revieksd all testimony, makes the following Findings, <br />Conclusions, and Order: <br />2. <br />That thero have been exceptional or extraordinary circumstances or <br />conditions applying to the subject property or as to the intended use <br />thereof that do not apply generally to othar properties in the same <br />vicinity or zone. <br />a. Finding: The lot is a 70' x 155° end slopes to the south. The <br />lot Ss locatnd in an R-1 zone xhich required a 20' rear yard <br />setback. The building area would be approuimately 30' x 95'• <br />The proposed house is 30' x �0' with a two-car garage. <br />b. Conclusion: Given the slope of the preperty and the lot depth, <br />tha location as proposed hy tha applicant is reasonable. <br />Tliat sueh variance is necessary for the preservation and enjoy9ent of a <br />substantial property right of the appellant possessed by the ownere of <br />other properties in the same vicinity or :.one. <br />a. Findtng: A varianee xas granted on Lot i7, the adjaoent lot for <br />the same reason. <br />b. Conclusion: This variance is consistent xith property in the <br />area. <br />3. That the authorization of sueh varian�e uill not be materially <br />detrimental to the public rtelfare or injurious to property in the <br />vicinity or zor.e in whieh the property is located. <br />a. Finding: Lot #5 and #7 properties rrill not be affected. Lot /5 <br />viev is to the northeast. Tha placement of this dwelling should <br />improve the view of Lot #5 over that of a normal setbacl:. <br />b. Conclusion: This varianee would not ba injurious to property in <br />the area. <br />4. That the grantiug of such vai•iance aill not adversaly affeet the <br />Comprehensive General Plan. <br />a. Finding: The Comprehensive Plan shows this area as single fam±ly <br />residential. <br />b. Conclusion: The variance will not affec:t the Comprehensive Plan. <br />
