.Ikb. <br />REQUEST FOR A VARIANCE AT 2931 N,ASSAU ST., EVERETT. WA 98201. <br />LOT 16. BLK 678, EVERETT DIV. C <br />FIRST REQUEST PART I <br />To keep existing fence in the front yard at 48'' instead of 42". <br />The front yard fence is on the west side of our lot. Existing 25' across <br />the west side, alone side the sidewalk. _ 9" along the south west side of <br />the front yard, �_ along the north west side of the front yard. <br />JUSTIFICATION FOR GRANTING THE FIRST REQUEST <br />We had Eagle Fence Company bid and install the fence. I. had origonally asked <br />for a 5' fence in the front- yard and Dale, from Eagle Fence who bid on the <br />job told me that we could go as nigh as 4' (48") in the front yard but that <br />I couldn't go 5' in the front yard. <br />Before I had the fence installed we had a survey done to justify the <br />property line because of a dispute with the owner of lot 15, on the north <br />side of our property. The survey cost us $290.00. The survey vas done by <br />Anderson Friel & Assn Inc., located at 2911-Q Hewitt Ave.. Everett. Wa 98201 <br />It was never my intention to have our fence installed to high, to be in <br />violation of the Everett Municple Code. The fence oust us $1408.94. for <br />both the front and back yard total. It; was only my intention to install a <br />fence to keep my child inside the yard, he is 2W years old and climbs up the <br />fence, a 42" fence he could surely climb over. The area we live in is not <br />the best. Every one of our neighbors has been broken into weither it be <br />their houses, cars, garage, thing being taken from the yard and out of their <br />boats. We had the chain link fence put up to keep our child in the yard and <br />to keep strangers from walking tnrough our yard. (people cut through the <br />old Social Security Biulding, now Providence health club, through the alley <br />then through our property to get to Nassau St.We have even had transients <br />pass out in our front yard before. <br />SECOND <br />REQUEST <br />(PART <br />II OF FIRST <br />REQUEST) <br />To keep <br />the 5' <br />high <br />fence,in the <br />back yard, running east & west on the north <br />side of <br />our lot <br />016._ <br />of fence <br />JUSTIFICATION FOR GRANTING THE SF.COUND REQUEST <br />Once again I was unaware of the fact. that Y the fence ran along side a <br />building it should be no higher than 42". The building l.hat our fence runs <br />along side of is Lot #15, which was an addition before the grandfather <br />clause, which would have prohibited the addition because it was built to <br />close to the property line. Lot N15 has a duplex on it, one on the west side <br />od the lot and the second on the east side of the lot facing the alley that <br />runs in between Nassau St. and W. Marine View Drive. Our fence is on our <br />property and the tenant in the alley appartement has no problem with access <br />in and out of his appartement. Due to the heavy foot traffic in that area, I <br />can see a 42" fence along north side of our lot would only be a hinderence. <br />People could easly jump over the fence as well as my child. We never had any <br />intention of installing the fence to high, especially since it cost us <br />81408.94 for the fence and $290.00 for the survey, a total of $1698.94. <br />I could see the fence being a problem if it was a wooden fence but view is <br />not cut off in any way.The bid for the fence took place before and after the <br />survey, most of the poles we set in place but no chain Link was installed at <br />the time of the survey. Noone ever said anything to me about the height <br />code of the fences not Eagle fence or the survey co. <br />
