REQUEST FOR A VARIANCE AT t931 N,ASSAU ST., EVERETT, WA 90201. LOT 16, BLK 678, EVERETT DIV. C FIRST REQUEST PART I To keep exiscing fence in the front yard at 48" instead of 42". The front yard fence is on the west side of our lot. Existing 25' across the west side, alone side the sidewalk. J q' along the south west side of the front yard, 19 along the north west side of the front yard. JUSTIFICATION FOR GRANTING THE FIRST REQUEST We had Eagle Fence Company bid and install the fence. I had origonally asked for a 5' fence in the front yard and Dale, from Eagle Fence who bid on the job told me that we could go as high as 4' (48") in the front yard but that I couldn't. go 5' in the front yard. Before I had the fence installed we had a survey done to jusr,ify the property line because of a dispute with the owner of lot 15, on the north side of our property. The survey cost us $290.00. The survey was done by Anderson Friel & Assn Inc., located at 2911-z Hewitt Ave., Everett. Wa 98201 It was never.- my intention ro have our fence installed to high, to be in violation of the Everett Municple Code. The fence cost us $1408.94. for both the front and back yard total. It was only my Intention to install a fence to keep my child inside the yard, he is 2s years old and climbs up the fence, a 42" Pence he could surely climb over. The area we live in is not the best. Every one of our neighaors has been :broken into weither it be their houses. cars, garage, thing being taken from the yard and out of their boats. We had the chain link fence put up to keep our child in the yard and to keep strangers from walking tnrough our yard. (people cut through the old Social Security Biulding, now Providence health club, through the alley then through our property to get to Nassau St.We have even had transients pass out in our front yard before. SECOND REQUEST (PART II OF FIRST REQUEST) To keep the 5' Ligh fence in the back yard, running east & west on the north Fide of our lot #16. 4 lof fence JUSTIFICATION FOR GRANTING THE SECOUND REQUEST Once again I was unaware of the fact that if the fence ran along side a building it should be no higher than 42". The building ghat our fence runs along side of is Lot #15, which was an addition before the grandfather clause, which would have prohibited the addition because .it was built to close to the property line. Lot Nib has a duplex on it, one on the west side od the lot and the second on the east side of the lot facing the alley that runs in between Nassau St. and W. Marine View Drive. Our fence is on our property and the tenant in the alley appartement has no problem with access in and out of his appartement. Due to the heavy foot traffic in that area, I can see a 42" fence along north side of our lot would only be a hinderence. People could easly jump over the fence as well as my child. We never had any intention of installing the fence to high, especially since it cost us 81408.94 for the fence and $290.00 for the survey, a total of $1698.94. I could see the fence being a problem if it was a wooden fence but view is not cut off in any way.The bid for the fence took place before and after the survey, most of the poleS we set .in plane but no chain ].ink was installed at the time of the survey.
