O � ,�/e � /.J �i hereIn- �verett r]'a J= � Fs-e� �� �c / S : 17 r <o ro�5 WHEREAS, Owner has applisd for a permit from the City of Everett which undee Ordinance No. 555-78 and Ordinance No. 665-80 require certsin improve- ments to be made to public righb of way as a condition to Lssuance of certain City permits; said Ordinances allow that the City Eng[neer may accept a covenant consenting to the formation of a local improvement district in lieu of havtng Owner construct and install the required public improvements when, in the opinion of the City Engineer, certain actuel improvements are not desirable due to imown or perce[ved physicel problems or the need for more comprehensive improvements; EREAS, Owner's property and the adjacent public rights ot way have bmined to require a covenant cunsenting to the formation of a local � district rather then having Owner make specific Improvements. _ W,iTHEREFORE, in consideration of issuance of applicable City py�'suant to Ordin�snce No. 555-78 and Ordinanc� No. 665-80 end in 1[eu ;pDblic right of way improvements Owner consents to the formation of a ;ovement district hereafter formed by the City or its successors or other iwners tor the public improvement of: ' /! i l � 1 . i i ' L i . or a portion thereof includ[ng street improvements defined In Ordinance Nos: 555-78 and 665-SO to include: The {nstellation of all public facilities required to improve the street to City design stendards including grading, drainage, pavernent, ciub/gutter, sidewalk, street lights, traffic signels and other neces- sary appurtenances. Such street improvements shall not be limited to the half street abutting the property; for example, where no per- manent street improvement existed, the street improvement shall be extended beyond the centerline a sufficient distance (10 ft. minimum) to permit safe movement of traffic. TAis Covenant consenting to the formation of a local improvement district applies (and precludes legal protest) only to the formation of r. local improvement district, Owner executing this document retains its, his/her or their rights under law to provide input or to make objection to the scope of the proposed public Improvements to be accomplished by such local improvement district ineluding nature and type of improvements es well as the proposed or final benefits und assessment therefor. The Ci:y shall deliver a signed releese of this Covenant to Owner after completion of public improvements as described hereinabove through the formation o[ a local improveRent district anc' after transmittai of the final assessment role to the County of Snohomish pursuant to law. The City may not utilize this Covenant for the formation of more than one (1) local improvement district. This Covenant consenting to the formatton of a Iocal improvement district ahr�ll be a covenant touching, concerning and running with the land and shnll be binding on Owner's heirs, assigns or successors in interest.
