Doard of Adjustment Minutes Regarding Blue ISay, Inc. <br />:lfter due consideration of the evidence presented by the Applicant; evidence <br />elicited during the public hearing; and as the result of the peraonal <br />inspection of the subject property and surrounding areas by the Everett <br />iiearing Examiner, the following findings of fact and conclusions constitute <br />the basis of the declsion of the Everett Hearing Examiner. <br />PINDINGS OF FACfS <br />1. The Applir.ant is the contractor for the resideuce to be developed on lot <br />17 of the Plat of Triada Granada, located at 4911 Nichols Place, <br />Everett, Washingto¢. The Applicant seeks a variance from the setback <br />provisions of EMC 19.12.050. He requests a variance for a 6' 2" side <br />yard setback instead of the required 7' 6" setback and an 18' front yard <br />setback instead of tlie required 20' setback. <br />7 <br />3. <br />The subject property is zoned RS, Single Family Suburban Residence. <br />The subject property is a lot that was part of the plat of Triada <br />Granada subdivision, approved by the City of Everett in October, 1983. <br />4. The lots surrounding the subject property are all zoned RS and are <br />developed, or are beiag developed, wlth single family residential. The <br />subject property is also zoned RS. <br />5. Nichols Place is an improved local access street which provides the <br />access to tha subject property. <br />6. Decause of topographic problems with the site, the City of Everett's <br />Planning Department in 1985 recommended that 20' front yard setbacks be <br />established on lots 9 through 21 oE the proposed plat of Trlada <br />Granada. (This was a reduction of the required front yard setbacks as <br />set forth in EMC 19.12.050.) The variance was granted by the Everett <br />Hearing Examiner based on the topographic conetraints and in particular <br />the severely sloped bank located on the eastern portlon of the proposed <br />lots. <br />
