A variance at 516 Morgan Road was granted in <br />December, 1987 and a variance For a side yard reduction at 2522 <br />Viewcrest Avenue was granted. Zt is noted, however, that all variances <br />stand on their own merit and are considered separately. <br />CONCLUSIONS <br />1. The application is for Lhe approval of a variance from the reduction of <br />the side yard and front yard setbacks at 4931 Yichols Place, Everett, <br />Washington. The Applicant requests approval of a 6' 2" side yard <br />setback instead of the 7' 6" setback and requests an 18' front yard <br />setback inatead of the required 20' setback. (It is noted that the 20' <br />setback was granted as part of a variance from the required 35' setback <br />as required in EMC 19.12.(150.) <br />2. The Bverett Hearing Examiner has jurlsdictional authority to liold the <br />hearing and to issue a decision. This authority is pursuant to the <br />provisions of Ordlnance 111323-87, Sectlon 12.A(1)H. It is also granted <br />pursuant to the fact that the Hearing Examiner has made decisions with <br />regard to variance and land use permits on this subject property. <br />3. In order for a variance to be granted within the City of Everett, the <br />criteria of &NC 19.70.060 must be sa[isfied. These criteria are <br />satisfied. <br />4. Exceptional and extraordinary circumstances exlst, including the slope <br />of the subject property and the confusion that resulted because of <br />administrative comments o¢ the building plane and permits for the <br />subject property. <br />5. The variance is necessary for the preservation and enjoyment of the <br />substantial property right. <br />6. A variance will not be detrimental to the public welfare nor injurious <br />to the property. <br />7. Thc granting of the variance will not adversely effect the Comprehensive <br />General Plan of the City of Everett. <br />DHCISION <br />Based upon the praceding Findinga of Facts and Conclusions, the testimony and <br />evidence submitted at the public hearing and upon the impreasions of the <br />Bverett Hearing Examiner of the site view, it is hereby ordered that the <br />variance for the reduction of the front yard setback from 20' to 18' and a <br />reduction of the side yard setback from 7' 6" to 6' 2" on property located at <br />4931 �ichols Place, Everett, Washington, is granted. <br />
