�+ <br />CITY OF EVERETT <br />BOARD OF ADJUSTMENT <br />MINUTES <br />January 3, 1983 <br />The regular mceting of the Board of Adjustment was called to order at 7:00 P. M. by <br />Chairman P.oss Hoagland. Also in attendance were Dewey Barnett and Doug Zook. <br />Item 1: <br />Applicant: <br />Location: <br />Variance Requested: <br />Zoning: <br />Gary Gill <br />5122 Dogwood Drive <br />Everett, WA 98203 <br />1311 �1Aukiltao Boulevard <br />A variance from E. M. C. 19.14.050 (C) <br />Rear Yard Setback. <br />R-I, Single Family Low Density <br />Residential <br />Don Wood of the Planning Department summarized the :C � r; -„rt as follows and <br />showed a slide of the site plan and the Land Use Map. <br />There is an existing unfinished house on the site which has s�t vacant for <br />approximately one year. The original builder created tiie deficient rearyard setback <br />of 18 feet instead of 20 feet by not placing the structure correctly on the site. <br />The house was not completed by the original owner because of financial problems and <br />the present applicant acquired the property from the mortgage company that had <br />repossessed Yhe property. After the aaplicant had a survey done, he found the rear <br />yard setback was only 18 feet instead of the required 20 feet, and is asking for a <br />variance so he will not be in violation of the code. The only alternative would be to <br />tear the house down which does not seem like a rea�onable solution as the setback <br />deficiency of two feet will not adversely affect the surrounding property owners. The <br />Planning Staff recommends approval of the variance request. <br />Dewey Barnett asked why this had not been caught by the Building Inspector. Ross <br />Hoagland raised the possibility of waiving the fee since this condition was not the <br />fault of the present owner. It was the consensus of the Board that the fee should not <br />be waived. <br />MOTION: Doug Zook moved to grant the variance as recommended by the Planning <br />Stafi. <br />Dewey Barnett seconded the motion and it was unanimousiy approved. <br />The meeting was adjourned at 7:10 P.
