M. C. Section <br />19.14.050 (C) rear yard setback <br />which requires each building to be <br />20 feet from the rear property <br />line. The new property owner <br />(Applicant) acquired the house <br />from mortgagor who had to <br />repossess the property from the <br />previous and original builder. The <br />house, at this time, is <br />approximately half completed and <br />the foundation sets 18 feet from <br />the rear property line. The <br />Applicani is requesting permission <br />to complete the existing structure <br />and correct the deficient setback <br />problem that was created by the <br />original builder. <br />R-1 Singie Family 4ow Density <br />Single Family Residential <br />North: R-1/Single Family <br />South: R-1/Single Family <br />East: R-1/Single Family <br />West: R-1/Single Family <br />Finding: The existing dwelling is half completed and has sat vacant for <br />approximately one year. The original builder created the deficient setback by <br />not siting the dwelling correctiy on the site. <br />Conclusion: The current property owner acquired the property from <br />mortgagor who repossessed the property. The Applicant is attempting to <br />solve a problem created by the original builder. <br />Preservation of Property RiRht: <br />Finding: The existing dwelling has been built to the extent that it now sits <br />without a variance. <br />Conclusion: It would be very difficult to move the house and its foudation at <br />this time. <br />Public Welfare: <br />Finding: The house has been sitting for some time in a very unsatisfactory <br />state of completion and is a degradation to the neighborhood in its current <br />state. <br />Conclusion: The variance request would allow the structure to be finished <br />and the house would become an asset to the neighborhood. <br />
