FINDINGS OF FACT <br />The Applicant requested approval of a Special Property Use Permit for <br />the replacement of an existing 40' PUD utility pole and installation of a <br />68-foot high wood utility pole with a two sector wireless antenna array on <br />property located at 3711 West Mukilteo Boulevard, Everett, Washington. <br />As part of the application, the Applicant requested a variance to allow the <br />wood utility pole to exceed the 20-foot height restriction on-site. <br />(exhibif 1) <br />2. Currently on-site is an existing 40-foot tall utiliry pole with a tran�former <br />near its top tliat is owned and operated by the Snohomish County PUD. <br />It is the intent of the Snohomish County PUD to remove the pole <br />because it is rotting and therefore must be replaced. The Applicant <br />approached Snohomish County PUD and negotiated an arrangement in <br />which a new 68-foot high wood utility pole with a two sector wireless <br />antenna array would replace the existing pole. While the PUD would use <br />a portion of the pole for electrical services, the ApplicanYs wireless <br />service wouid be attached to the top of the pole and separated 15 feet <br />from the PUD power lines. (exhibit 1) <br />3. EMC 19.41.150.D.i.c(3) limits the height of replacement structures for a <br />wireless facilities to a maximum of 20 feet above the height of the <br />existing pole. Because the existing structure is 40 feet high and the <br />proposed pole would be 68 feet high, a variance is required. (exhibit 1, <br />Tyler festimony) <br />4. The subject property is zoned B-1, Neighborhood Business. It is <br />developed with a small grocery store, deli and a parking lot. (exhibit 1) <br />5. The properties to south and east are zoned B-1 and developed with <br />commercial and residential structures. The property to the west is zoned <br />"P" and developed as a park. The property to the north is zoned R-S and <br />has single-family development. (exhibit 1) <br />6. The proposed pole is classified by the City of Everett as a"major above- <br />ground utility" and is subject to Review Process III (see pages 5-19 of the <br />City of Everett Zoning Code). For majur above-ground utilities, the <br />General Evaluation criteria and Specific Evaluation criteria are set forth <br />in EMC 19.41.150.0 and 19.41.150.D.1.c. (exhibit 1) <br />3 <br />� <br />
