- <br /> MU , 1�c� <br /> G 12� <br /> NOTICE OF CITY ACTION <br /> PLANNING DIRECTOR DETERMWATION <br /> II.Bil29-94 <br /> Dear Citizen: � <br /> INTRODUCTION: The City of Everett Planning Department has received an application from Ken <br /> Oswald, 18342 ISth Place NE, Seattle, WA 98155, to build an 12' X l6' bedroom addition to the <br /> existing residence at 26 E. Marilyn Ave. Section 38.050 allows the expansion of a single family dwelling <br /> that is non confomung in setback subject to review process II.B. Review process I1.B involves a written <br /> decision by the to "...approve, disapprove, or approve with conditions the use proposed by the applicant" <br /> (Section 42.100.B). <br /> BACKGROUND: 1'he property is located in the R-1, Single Family Residential Zone. The required <br /> setbacks are 20' from the front and rear property Gnes and 5' from the interior side property lines. There <br /> are two e�asitng single family houses on the property. The house in the rear of the property was built in <br /> 1940 and is non conforming as it is located on:v 8 feet 9 inches from the rear property line. <br /> FINDINGS: The adsting house in the rear of the property has an 8 foot 9 inch setback &om the <br /> rear property line. The dwelling's setback has been certified as a legal non conforming setback (See NCU <br /> #12-93). The new addition will maimein the same 8 foot 9 inch setback&om the rear property line, <br /> DECISION: The Planning Director has detern�ined to allow for the proposed addition as shown <br /> on the attached site plan with the following conditions: <br /> • 1. Necessary building pertnits are to be obtained by the applicant from the Building <br /> Department. <br /> Right to Appeal: The applicarn or an owner of property located within 300 feet of the subject property <br /> may appeal the Planning Director's detemunadon as to whether the proposed use should be a pemutted <br /> use w�thin the appGcable zone district, pny such appeal must be filed within ten (10) calendar days of the <br /> date speci6ed below. Appeal fo�ms are available from the Planning Department and must be submitted <br /> along with the ra{uired 61ing fa.
