PLANNING DIRECTOR DETERMINATION <br /> Review Process If #13-97 <br /> INTRODUCTION: The City of Everett Planning Department received an application from <br /> Craig Tidrick, 1107 E. Marine View Drive, Everett, WA 98201 for a second story bedroom and <br /> bath addition to his existing single family residence located at 1107 E. Marine View Drive. <br /> The new addition will have the same setback from the south side property line as the existing <br /> house structure of only 30 inches. Section 38.040 allows for the Planning Director to permit <br /> the expansion of a structure which does not meet required setbacks or height, provided that <br /> the expansion does not make the setback or height more nonconforming; that the expansion <br /> complies with all other requirements of the zoning code ordinance; and that the nonconformity <br /> has been certified by the Planning Department. <br /> BACKGROUND: The property is located in the R-2, Single Family Residential Zone. The <br /> typical required setbacks are 20' from the front and rear property lines and 5' from the interior <br /> side property lines for a single family residence and accessory structures. The existing <br /> residence is located only 30 inches from the south side property line. It was originally <br /> constructed in 1901 according to the Snohomish County AssessoPs records. The zoning <br /> code requirement for a minimum 5' building setback far structures from a side property line <br /> became effective December 31, 1956. <br /> FINDINGS: The existing residence has a 30 inch setback from the south side property <br /> line. This structure's setback has been certified as a legal nonconforming setback (NCB #13- <br /> 97). The applicant proposes to add on to the residence with the same setback from the south <br /> property line with no further encroachment. <br /> DECISION: The Planning Director has determined to aliow for the proposed addition <br /> with a 30 inch setback from the south property line with the following conditions: <br /> 1. Necessary building permits are to be obtained from the City of Everett's Building <br /> Department prior to construction. <br /> Right to Appeal: The applicant or owner of property located adjacent to the subject property <br /> or any property owner who deems himself aggrieved and will thereby suffer a direct impact <br /> from the proposal may appeal the Planning Oirector's determination as to whether or not the <br /> proposal should be permitted. Any such appeal must be filed within fourteen (14) calendar <br /> days of the date specified below. Appeal forms are availabie from the Planning Department <br /> and must be s�bmitted along with the required filing fee.
