FINDINGS AND DECISION ��w. w�d`� <br /> OFTHEHEARINGEXAMINEROFTHE rd���3� <br /> CITY OF EVERETT <br /> � -LL-oS <br /> IN THE MATTER OF THE APPEAL <br /> OF M&S ASSOCIATES, LLC OF AN <br /> ADMINISTRATIVE DECISION DENYING <br /> A NON-CONFORMING USE CERTIFICATION APPEAL #05-002 <br /> DECISION: It is hereby ordered that the City of Everett <br /> Planning Dlrector's Determination denying the <br /> Certification of Non-Conforming Use is <br /> overturned, and the City should issue a Certificate <br /> of Non-Conforming Use to the Appellant for two <br /> residential units on property located at 1�t31 East <br /> Marine View Drive, Everett, Washington. <br /> INTRODUCTION <br /> M&S Associates, LLC (Appellant) filed an application for a Non-Conforming Use <br /> Certification for a second residential dwelling unit on F�roperty located at 1131 East <br /> Marine View Drive, Everett, Washington (subject property). The subject property is <br /> zoned R-2, Single-Family Residential which, under most circumsiances, does not permit <br /> more ihan one residenlial unit per lot. On July 7, 2005, the City of Everett Planning <br /> Department issued a denial of a Non-Conforming Use Certification for the second <br /> dwelling unit at the subject property. The Appellant filed an appeal of the Everett <br /> Planning Department decision. <br /> A liearing was held before the Hearing Examiner of the City of Fverett on September <br /> 22, 2005.
