(exhi6its 15 & 16) There is no record that the City has reviewed or ever <br /> permitted the second residential unit. <br /> 8. Harold Carlson was the applicant for Construction Permit No. 5531 issued by the <br /> City of Everett in 1954. (exhibit 13) Mr. Carlson constructed the structure and <br /> according to his granddaughter, Lisa Saunders, built it with two residential units, <br /> one in the upper story back portion and one in the lower story back portion of the <br /> structure. According to Ms. Saunders, Mr. Carlson lived in the upper residential <br /> unit, and various families have lived in the lower unit. Each residential unit had <br /> its own kitchen, fireplace, bedroom, living room, dining room, etc. (exhibif 8, <br /> Saunders tesfimony) <br /> 9. Ms. Joann Carlson, the mother of Ms. Saunders, was raised in a residence <br /> across the street from the subject property. In 1954 she was dating Kenneth <br /> Carlson, the son of Harold Carlson. In 1954 Kenneth Carlson was independent <br /> from his parents and was li��ing in the second apartment unit at 1131 East Marine <br /> View Drive. Ms. Carlson eventually married Kenneth Carlson and during the <br /> ihree-year courtship was aware of two residential units on-site. (exhibit 19) <br /> 10. Apparently, Harold Carlson sold the structure and business to a party idenlified <br /> as Harts. It is not clear from the records as to the dale the Harts purchased the <br /> subject property (rom the Carisons. In 1972, the Harts sold the subject property <br /> to a woman named "Marie". In 1977, Arlene Solem and her husband purchased <br /> the grocery store from "Marie" and worked in the store (then named Arlene's <br /> Market) until 1986. Arlene Solem's husband managed the store until 1991, al <br /> which time the grocery store was sold back to the Carlsons. According to Arlene <br /> Solem, during the 19 years that she either worked or owned the grocery store at <br /> 1131 East Marine View Drive, Everett, Washington, there were two residential <br /> dwelling units in lhe back portion of the grocery store (upstairs and downstairs), <br /> and there were diKerent families living in each of these units. (exhibit 10) <br /> 11. In 1997, Roberl St. John purchased ihe subject properly from the Carlsons. <br /> Darlene Weiss submilted ihat she continued to work al the grocery store for one <br /> and one-half years. After this sale, according to Ms. Weiss, during the years she <br /> worked at the grocery store at 1131 E. A4arine View Drive, Everett, Washington, <br /> there were lwo residential units in the attached residential structure occupied by <br /> numerous tenants. (exhibit 9) <br /> 12. In lale 1997 or early 1998, the subject property was reclaimed by the Carlson <br /> family. In 1999, the Appellant purchased ihe subject propert; and continued to <br /> operate the grocery store.
