6. The non-conformity of the residential use was established at the time of the <br /> zoning of the subject property. While the building permit only permitted one <br /> residential unit, the building permit was issued prior to the establishment of the <br /> zoning designatior that occurred in 1956. The subject property is non- <br /> conforming in commercial use, as well as residential use. <br /> DECISION <br /> Based upon the preceding Findings of Fact �ind Conclusions and testimony and <br /> evidence submitted at the public hearing, it is hereby ordered that the City of Everett <br /> Planning Director's Determination denying the Certification of Non-Conforming Use is <br /> overtumed, and the City should issue a Certificate of Non-Conforming Use to the <br /> Appellant for two residential units on property located at 1131 East Marine View Drive, <br /> Everett, Washington. <br /> Done and dated this 21st day of October, 2005. <br /> '►� �1• �W,�cc�w�� <br /> Jam .
