Marine Vie�v Drive <br /> Desr Mr. Duce: <br /> The F urpose of this letter is to clarify the uses which are pertnitted to be established at <br /> the a'�ove referenced address. The structure located on site has been determined to be <br /> a legal nonconforming use. Historically the structure was used as a church from 1964- <br /> 1985. In 1985 the City approved the change of use from church to a ceramic shop, City <br /> of Everett Land Use Permit#NCU85-015. There were several conditions of approval <br /> contained in the NCU determination, including the condition that any further change of <br /> use, alteration, or expansion will require review and approval from the City. <br /> Everett Municipal Code Section 19.36.030.0 allows for a nonconforming use to be <br /> changed to another use oniy if such use is not more nonconforming than the existing <br /> nonconforming use. The new use shall be approved by the City using Review Process II <br /> as outlined in EMC Title 15, Local Project Review and Procedures Ordinance. The <br /> present use of the building was for a band rehearsal hall. Upon a preliminary evaluation <br /> of this proposal the City found that the use is an expansion of the previously approved <br /> nonconforming use, and therefore would not be permitted on site. <br /> Use of the structure for a single-family residence is pertnit?ed outright, provided that all <br /> necessary building permits are obtained prior to any remodel work.
