WHEREAS, Principal has agreed to conswct the improvements at the followin; location which is located in the City of Everett, County of Snohomish, State of Washington, and is described as follows: 903 East Marine View Drive Everett, WA 98201 (SEPA #39-94) ; and VVHEREAS, the City is requiring the Principal to provide a bond guaranteein; the construction of said improvements. NOW, THEREFORfi, THE CONDITION OF THIS OBLIGATION IS SUCH, that if the said Principal shall construct, or have constructed, on or before the 26thday of Sentember , 199 4 or at such earlier date when requested to do so by the Ciry, the improvements herein described in accordance with approved plans and in conformance with City standard specificacions, to the satisfacdon of the City Engineer, and shall save the City hazmless from any loss, cost or dama;e by reason of its failure to complete said improvements, then this obligation shall be null and void; o[herwise to remain in full force and effect. In the event the City is requiretl to insdtute litigation to obtain performance pursuant to this bond, Principal and Surety agree to pay all reasonable attorney's fees and costs which are incurred by the City.
