WHEREAS, Principal t as agreed to construct the improvements at the followin; location which is <br /> located in the City of Everett, County of Snohomish, State of Washington, and is described as <br /> follows: 903 East Marine View Drive Everett, WA 98'LO1 (SEPA N39-94) <br /> ; and <br /> WHEREAS, the City is requiring the Principal to I�rovide a bond guaranteeing the construcdon of <br /> said improvements. <br /> NOW, Ti�IEREFORE, THE CONDTTION OF THIS OBLIGATION IS SUCA, that if the said <br /> Principal shall construct, or have constructed, on or before the 26thday of September , 199 4 <br /> or at such earlier date when requested to do so by the City, the improvements herein described in <br /> accordance with approved plans and in conformance with City standard specifications, to the <br /> satisfacdon of the Ciry Engineer, az:d shall save the City harmless from any loss, cost or dama;e by <br /> reason of its failure to complete said improvzmen[s, then this obligation shall be null and void; <br /> otherwise to remain in full force and effect. <br /> In the event the City is required to insdtute litigation to obtain performance pursuant to thi� bond, <br /> Pn.'ucipal and Surety agree to pay all reasonabie attorney's fees and costs which are incurred by the <br /> Ciry. <br /> SIG23ED, SEALED and DELIVERED this 25th day of Seatember , 1994 . <br /> � P.
