Criterion No. 2- <br />That such variance is necessary for the preservation and enjoy- <br />ment of a substantial property right of the appellant possessed <br />by the owners of other properties in the same vicinity or zone. <br />a. Findina: other corner lots in the City have front yards <br />oriented towards the length of the lot instead of <br />the width, and in the past the Board has granted <br />variances in similar situations. <br />b. Conclusion: Granting this <br />property right <br />ity and zone. <br />Criterion No. 3: <br />variance will allow the Applicant a <br />possessed by others in this vicin- <br />That the authorization of such varianc2 will not be materially <br />detrimental to the puClic welfare or iniurious to property in the <br />vicinity or zone in which the property is iocuted. <br />a. Findinqs: There have been no adverse comments received in <br />response to notice sen•c to property owners within <br />300 feet, and a lett•et waa submitted by the adja- <br />cent owner to the south supporting the request. <br />b. Conclusion: it does not appear that granting this variance <br />would Se detrimental to the public welfare or in- <br />jurious to other property in the vicinity and <br />zone. <br />Criterion No. 4: <br />That the granting of such variance will not adversely affect the <br />Comprehensive General Plan. <br />a. Findina: The General Plan designation for this site is <br />single family detached and the five foot setback <br />as proposed functions as a side yard and is in <br />keeping with the side setback for this designa- <br />tion. <br />b. Conclusion: Grantinq this variance will not adversely affect <br />the General Plan. <br />NoW, THEREFORE, the Board of Adjustment of the City of Everett <br />does hereby order that the variance be GRANTED to allow a five <br />foot rear yard instead of the twenty foot rear yard required by <br />code and further require the applicant to meet the following con- <br />dition. <br />1. The Applicant shall obtain all necessary building and pub- <br />lic works permits. <br />The action of the Board of Adjustment in GRANTING a variance <br />shall be final and conclusive, unless within fifteen (15) days <br />from the date of issuance and signing of this order by the Chair- <br />man of the Board, an aggrieved person or persons obtains a writ of <br />certiorari from the Superior Court of Washington for snohomish <br />County for the purpose of review of the action taken. <br />DATED this_first day of Mav� , 1989. <br />t.C�t� r�/ -'e �_ t �� , - <br />Chairman, Board of Adjustment <br />� <br />
