These letters are attached as <br />Exhibits # 9 and N10. <br />Criterion No. 3: <br />hat t'I�e vana ce will only grant the subject property the same general <br />rights enjoyed by other property in the same azea and zone as the subject <br />property. <br />a. �Find�in s: The applicant states that the vaziance will only <br />grant the subject property the same rights enjoyed by other <br />properties that are bmlt along Interstate Five. A fence height <br />of 42 inches would do nothing to block out the vieK� of cars <br />and trucks zipping by at 60 miles an hour. Also, the <br />requested variance would do little to block out the noise but <br />would at least g:ve some relief to the view. <br />b. Conclusions: The immediate area is developed with <br />pr ommantly single family residences. There were no <br />similar retaining wall structures or fences in the azea of the <br />subject property. Driveways in the uea range from <br />approximately 10 feet wide to 30 feet wide w�th the average <br />driveway being about 20 feet wide. <br />Criterion No. 4: <br />hat e vu►ance is the minimum necessary to allow the subject property <br />the general rights described in Criterion 3. <br />a. Findingc: See Criteria N:;. <br />b. Conclusions: See Criteria k3 <br />Criterion No. 5: <br />he grant►ng o the variance is consistent with the goals and policies of <br />the Everett General Plan. <br />a. �F�i�ndin�s : The Everett General Plan designates this property <br />as-1� S'mgle Family Detached. <br />b. Conclusions: The proposed use of the subject property as <br />residenttal-is consistent with the Everett General Plan. <br />Criterion No. 6: <br />he need or the requested variance is not the result of a self-created <br />hardship. <br />a. Findings: The applicant states that the priot existing wood <br />retaining wall had failed due to yeus of deterioration causing <br />a land slide situation. The urgent need for this retaining wall <br />to be replaced with a more suitable material for this rype of <br />application was agreed between the applicant and the affected <br />neighbor. The sidewalk along side of the home in this area <br />was severely damaged. It was cracked, detached and the <br />underlying foundation had washed away. The slope was 45 <br />
