Conclasiof.,: The variauce is to allow an already <br />cons�ntaining wall and fencing that dces not comply <br />with zoning code requirements to remain on tlte site. The <br />requested variance is necessary to avoid removal or <br />modification of the ezisting retaining wall and fencing <br />improvements. A 20-foot wide driveway is more than <br />adequate to provide access to the existing garage. <br />NOTE: At the hearing tf►e applicant stated that the variance request for <br />the driveway was no longer needed and only the retaining wall and fence <br />variance is needed. <br />NOW, T�REEFORE, the Board of Adjustment of the City of Everett does hereby order <br />that a variance be GRANTED to allow for the existing retaining wall and fenx to remain <br />with the following condidon: <br />A covenant wluch stipulates that the properry owner is liable for the retaining wall. <br />The action of the Boazd of Adjustment in GRANTING a variance shall <br />be final and conclusive, unless within twenty-one (21) days from the date <br />of issuauce and signing of this order by the Ct►airman of the Board, an <br />aggrieved person or persoac obtains a writ of certiorari from the <br />Superior Court of Washington for Snohomish County for the pucpose vf <br />review of the acdon taken. <br />� • � � • �� .. � • �� i�� � <br />/ <br />-%/��.�'�_. <br />, : �� : � :*,r• , � ��� � <br />
