8 West Marilyn <br />Everett, WA 98203 <br />Dear Ms. Phan: <br />RETURN RECEIPT REQUESTED ��rts �ePt. <br />On April 12, 1991, a STOP WORK ORDER was posted on your property at <br />3624 Upland Avenue. <br />T!�.e order was posted to prevent any further removal of the vegetative buffer <br />on the south east boundary of your lot - along the creek. <br />The removal of the buffer area is in violation uf Section 37.160 Development <br />Activity and Improvements in or near a stream, lake, or wetland. <br />2. Rehabilitation. The City may permit or require the applicant to <br />rehabilitate and maintain a stream, iake, or wetland by removing <br />debris, sediment, vegetation, or other material detrimental to <br />the area, replanting disturbed veQetation, or by other methods <br />deemed appropriate by the Planning Director. Rehabilitation may <br />be required at any time that a condition detrimental to water <br />quality or habitat exists. <br />The enforcr_ment provisions which are detailed in Section 37.200 are as follows: <br />B• Any person, firm, corporation, or association or any agent thereof who <br />vio.lates any of the provisions of this Section shall be guilty of a <br />misdcm=anor punishable by a fine not to exceed $1,000.00. It shall be <br />a separate offense for each and every day or portion thereof during <br />which any violation of any provisions of this Section is committed. <br />C• Any person, firm, corporation, or association or any agent thereof who <br />violates any of the provisions of this Section shall be liable for all <br />damages to publ.ic or private property -arising from such violation, <br />including the cost of restoring the affected area to its condition <br />prior to such violation or to such other condition acceptable to the <br />City. <br />D. Restoration shall include, but not be limited to, the replacement of <br />all improperly removed ground cover crith species similar to those which <br />were removed or other approved species such that the biolr,;ical and <br />habitat values will be replaced, improper fill removed a:nd slope <br />stabilized. <br />Location: 273?
