CITY OF EVERETT <br />PLANNING DIRECTOR DECISION <br />Review Process If #11-97 <br />July 9, 1997 <br />The City of Everett Planning Department approves a request by Donald & Sarita <br />Rodenhizer to crostruct a 24' X 15.5' single story addition along the same side <br />setback line of the existing residence at 2111 McDougall Avenue. The existing <br />residence does not meet the five foot side setback from the north property line. The <br />residence's nonconforming setback was certified under NCU #6-97. <br />1. Encroach no further into the side setback than the setback of the existing <br />residence. <br />2. Obtain necessary building permits from the City of Everett's Building <br />Department. Compliance with the State Building code is required. <br />Subsection 38.040 of the City of Everett Zoning Code allows for the Planning Director <br />through Review Process II to allow for the expansion of a structure which does not <br />meet required setbacks or height, provided that the expansion does not make the <br />setback or height more nonconforming; that the expansion complies with all other <br />requirements of the zoning code ordinance; and that the nonconformity has been <br />certified by the Planning Department. <br />Right to Appeal: The applicant or an owner of property located adjacent to the <br />subject property may appeal the Planning Director's determination as to whether or <br />not the proposal should be permitted. Any such appeal must be filed within fourteen <br />(14) calendar days of the date specified below. Appeal forms are available from the <br />Planning Department and must be submitted along with the required filing fee.
