Page 36 of 46 <br />unavoidable interruption of operation and degradation of effluent qualiry, shall be scheduled <br />during non-critical water qualiry periods and carried out in a manner approved by Ecology. <br />G23. REQUESTS TO BE EXCLUDED FROM COVERAGE UNDER THE PERMIT <br />Any discharger authorized by this permit may request to be excluded from coverage under <br />the gener.l permit by applying for an individual permit. The discharger shall submit to the <br />Director an application as described in WAC 173-220-040 or WAC 173-216-070, whichever <br />is applicable, with reasons suppoRing the request. These reasons shall fully document how an <br />individual permit will apply to the applicant in a way that the general permit cannot. Ecology <br />may make specific requests for information to support the request. The Director shall either <br />issue an individual permit or deny the request with a statement explaining the reason for the <br />denial. When an individual permit is issued to a discharger othenvise subject to the <br />construction stormwater general permit, the applicabiliry of the construction stormwater <br />general permit to that Permittee is automatically ternunated on the effective date of the <br />individual permit. <br />G24. APPEALS <br />A. The terms and conditions of this general permit, as thcy apply to the appropriate class of <br />disc�iargers, are subject to appcal by any person within 30 days of issuance of this general <br />permit, in accordance with Chapter 43.21 B RCW, and Chapter 173-226 WAC. <br />E3. The terms and conditions of this general permit, as they apply to an individual discharger, <br />are appealable in accordance with Chapter 43? 1 B RCW within 30 days of the efS'ective <br />date of coverage of that discharger. Consideration of an appeal of general permit <br />coverage of an individual dischargcr is limited to the general permiPs applicabiliry or <br />nonapplicabiliry to that individual discharger. <br />C. Thc appeal of general permit coverage of an individual discharger does not affect any <br />other dischargers covered under this aeneral permit. If the tcrms and conditions of this <br />general pennit are found to be inapplicable to any individual discharger(s), the matter <br />shall be remanded to Ecology for consideration of issuance of an individual pem»t or <br />permits. <br />G25. SEVERABILITY <br />Thc provisions of diis pemlit are severable, and if any pro�•ision of d»s pertnit, or application <br />of any provision of this pemiit to any circumstance, is held invalid, the application of such <br />provision to other circumstances, and the remainder of this permit shall not be affected <br />thereby. <br />G26. BYPASS FROHIBITED <br />A. Bvnass Procedures <br />Bipass, �vhich is the intentiunal diversion of waste streams from any portion of a <br />treatment facility, is prohibited for stormwater events below the design criteria for <br />
