This easement is granted subject to and conditioned upon the following <br /> tecros, conditions and covenants: <br /> 1. The Gcantoc shall at all times conduct its activities and all <br /> other activities conducted on Grantoc 's property so as not to interEece <br /> with, obstcuct or endanger the usefulness of any impcovements, �or other ' <br /> facilities, now or hereafter maintained upon the easement, oc in any Way <br /> interfere with, obsteuct or endangec the Clty's use of the easement. <br /> 2. Prior to any constcuction, work oc any othec activity by the <br /> Grantoc on the easement, a notification and plans for the same shall be <br /> submitted in writing to the City by the Grantor and no such construction, <br /> wock or act:vity by the Grantoc shall be commenced without the City's pcior <br /> written appcoval; PROVIUEo, HOWEVER, Any changes or revisiona in the plans . <br /> shall also be subject ta the city's pcior appcoval, The City's review of <br /> the G[antoc 's plans undec this easement shall not be deemed to impase any ' <br /> duty or obligation on the City to determine the adequacy or sufEiciency oE <br /> the Crantoc 's plans and designa nor whether the Gcantor 's construction, wock <br /> or activity is in confocmance with other applicable plans, codes and <br /> regulationa. purther, approval by the City to auch construction, wo[k or <br /> activity shall not in any manner be considered as imposing any obligation, <br /> duty or liability upon the City as to the safety or propciety of such <br /> construction, work or activity. <br /> ' 3. The Grantor hereby authorizes the city to cut, trim and cemove <br /> any and all bruah, tcees, other vegetation or dAbcis upon the easement and <br /> the cight oE access for such purposes. Grantor also authocizes the City to <br /> cut, trim and remove any and all brush, tcees, other veyetation and debria <br /> on Grantor's pcoperty which, in the City's reasonable judgment, constitutes <br /> a hazard to the easement and the right of access for such purposea. <br /> 4.
