The appli�ant must compy with all 13 conditlons of Sedion 39.020.D of the Cit�s <br /> Zoning Cade (as summarized below), as well as all other provisions of fhe Cily's <br /> Zoning Code and all other applicabb CNy codes. <br /> Accessory dwelling units are pertnitted subjed to approvel by the Planning Diroctor using Reviaw <br /> Process I. The Planning. Diredor, using Review Process I, is autho�ized to '...approve, <br /> disapprove, or approve with conditlons the use proposed bY Me appflcant" (Subsection 41.100.8) <br /> !f no appeal is fiied in rosponae to the Planning Directors detertninetlon, the dedsion wiil be <br /> considered final. If an appeal of t!�,e decision is filed, such an appeal must be submitted to ihe <br /> City's Hearing Examiner. <br /> Subsectlon 39.020.n of the Zoning Code establishes 13 aiteria by which such prc"osals must be <br /> eoaluated. These are as follows: <br /> 1. The lot is approximately 17,000 square feet in area. <br /> 2. Each single famfly dwelling on a legal building lot ahall not have more than one <br /> accessory dwelling unit. No �eccessory dwelling may be located in any d�taeh�d <br /> acceasory suvcture. <br /> The proposed action is far one accessory dwelling unit only, and the entlre unit will be within <br /> the original residence. <br /> 3. One of the dwelling units ahall be oceupied by one or mnro owners of the prop�rty as <br /> the owner's permanent and principal residence. <br /> The owner of the property will be required to submit a certification that he owns and resides <br /> at the subject property. <br /> 4. The floor area of the accessory dwellirtg unk ahall not ezceed 40K of the total floor <br /> area of the structure, ur 800 square feet, whfehevtr is less. <br /> The floor area of the residence is approximately 3,100 square feet. The flaor area of the <br /> proposed accessory dwelling unit is approximately 650 square fee� which is less than 40% <br /> of the total floor area. <br />
