Ross Perry <br /> 4031 Lincoln Way <br /> Lynnxood, WA <br /> hereinafter referred to as "Applicant," for a variance from E.M.C.: <br /> 19.18.040(A), Front Yards and (B), Rear Yards far construction of <br /> three multiple family dwellinga on three aeparate lots. For Lot 4, a <br /> ten foot rear yard is proposed instead of the twenty foot required by <br /> Code. For Lot 3, a ten foot rear yard is prop�^ed inatead of the <br /> twenty feet required by Code, and for Lot 2, a ten foot front yard <br /> and a ten foot rear yard instead of the twenty feet required by Code. <br /> on the following described praperty: <br /> Lots 2, 3 and 4 of Short Plat of Lot 4, Plat of Valley View, as <br /> recarded in Vol. 1387, p. 1644, Records of S¢ohomish County. <br /> commonly knovn as: 7601 Ridgewood <br /> The Board of Adjustment, Eollowing a public hearing on said application held <br /> on February 6, 1989, and further having revieeed all testimoay, makes the <br /> following Findings, Conclusions and Order: <br /> FINDZNGS AND CONCLUSIONS: <br /> Criterion O1: That there have been exceptional or eztraordinary <br /> circumstances or conditionF applying to the subject property <br /> or as to the intended use thereof that do not apply <br /> generally to other properties tn the same vicinity or zone. <br /> a. Find3ng: The sub�ect property consists of three <br /> separate vacant lo[s, each slightly more than 6,200 <br /> square feet in area. The zoning is R-3, Multiple Family <br /> Low Density Residential, rrhich requires 1500 square feet <br /> of lot area per dvelling un3t. Fach lot has the <br /> � potential for four dwelling �nits if all Zoning Code <br /> requirements are met. The property is being marketed <br /> and the potential purchaser viahea to construct a <br /> fourplex on each lo[. The Applicant feels that in order <br /> to be able to get four units on each lot, he must have a <br /> variance for rea: setback. <br /> Since the site is vacant, there is a great deal of <br /> design flexibility available, and it should be posaible <br /> to deaign a project to meet all Zoning Code requiremente <br /> without obtaining a variance. The site plan submitted <br /> by the applicant is purely epeculxrive and doea not make <br /> any provision for a usable front yard, and the ten foot <br /> rear yard area is not adequate to pro�ide any usable <br /> open space as is customary in this vicinity and zone. <br /> b. Conclusion: Since the site is vacant, it should be <br /> possiblQ to design a project to meet Zoning Code <br /> requireme�ta, and the conclueion is [here are no unusual <br /> or extraorni.nary circumstances applying to this property <br /> that do not apply generally to the vicinity and zone. <br />
