This decfsion is based on e four page plan set prep3red by GFK Consuiting Inc,drawn August <br /> 19,2009 and received by the City of Everett on January 13, 2010. <br /> 2. The property is zoned M-2 heavy industriel. The proposed indusUial use and outdoor storage <br /> are permitted uses(Table 5.2 Chapter 19 EMC). <br /> 3. The site has historically supported industrial uses, includfng treating of lumber. Such uses <br /> have resulted in soils being contaminated and subsequently remedfeted to Department of <br /> Ecology standards and remains under a consent decree. Among other things,the remediatlon <br /> included the placement of en asphalt cap over contamfneted areas,atop which the present use <br /> occurs. The presence of this contaminatfon precludes surtace disturbance. :�an aRemative <br /> to standarcl landscaping(trees, shrubs and ground cover), the applicant proposes planting ivy <br /> to soften the visual impact of the concrete screening wall. <br /> 4. The present use commenced without prior City authorizetion,whfch triggered code <br /> enforcement actions, Subsequently the City and the applicant agreed to a third party <br /> arbitration regarding permit specific requirements and standards to be followed. The arbiUator <br /> determined that the use does not require a shoreline petmit, that publlc access need not be <br /> provided, and that fencing screening the outdoor activities need not be more than six teet high. <br /> The arbitrator did not consider whether physical improvements would necessitate a shoreline <br /> permit. <br /> 5.
