7 Return to: Snohomish County Parks and Recreation 3000 Rockefeller MS 303 Everett WA 98205 INTERLOCAL AGREEMENT For Funding of 10th Street Marine Park Improvements SECTION 1 General Conditions This Agreement is made by and between the PORT OF EVERETT, a municipal corporation, hereinafter referred to as "Port,"the CITY OF EVERETT, a municipal corporation, hereinafter referred to as "City," and SNOHOMISH COUNTY, a political subdivision of the State of Washington,hereinafter referred to as "County." The Port, the City, and the County will be collectively referred to as "the parties." NOW, THEREFORE,the County,the City and the Port agree as follows: 1.1 Premises. The premises, commonly known as the 10th Street Marine Park, are located at 10th Street and West Marine View Drive and are owned by the parties as tenants in common with each party holding title to a one-third undivided interest. (a) The premises were acquired by the parties in 1972. The parties entered into a twenty-year agreement in February 1995 as to the parties mutual rights and responsibilities with respect to the premises. The twenty-year agreement, also known as that certain Interlocal Agreement for Funding of Marine Park Boat Ramp, dated February 15, 1995, is attached hereto as Exhibit A and incorporated herein by this reference. The premises are legally described in Attachment A of the twenty-year agreement. 1.2 Purposes and Objectives. In 1995, the parties anticipated the likelihood of there being future additional improvements to the Marine Park premises. Paragraph 3.2 of that certain Interlocal Agreement for Funding of Marine Park Boat Ramp dated February 15, 1995, or Exhibit A, states: The Port, City or County may propose additional development plans for the recreation site after consulting with other parties. . . .concerning the feasibility of such development.
