14 <br /> 6. Compensation for the Hearing Examiner for the services pursuant to this Contract shall <br /> be at the rate of a monthly retainer of Five Thousand Dollars ($5,000.00)per month. The <br /> Hearing Examiner shall be reimbursed for long distance telephone calls which he makes <br /> to the City for the purpose of carrying out his duties as Hearing Examiner up to a <br /> maximum of Twenty-five Dollars ($25.00)per month. Documented proof of such calls <br /> must be provided prior to payment. <br /> 7. Notices <br /> A. Notices to the City of Everett shall be sent to the following address: <br /> City of Everett <br /> Attn: Mayor's Office <br /> 2930 Wetmore Avenue <br /> Everett, WA 98201 <br /> B. Notices to the Hearing Examiner shall be sent to the following address: <br /> James Driscoll <br /> 101 Yesler, Suite 607 <br /> Seattle, WA 98104 <br /> 8. This Contract contains the complete and integrated understanding and agreement <br /> between the parties and supersedes any understanding, agreement of negotiation whether <br /> oral or written not set forth herein. <br /> 9. It is agreed that venue for any lawsuit arising out of the Contract shall be Snohomish <br /> County. <br /> 10. Any waiver by the Hearing Examiner or the City or the breach of any provision of this <br /> Contract by the other party will not operate, or be construed, as a waiver of any <br /> subsequent breach by either party or prevent either party from thereafter enforcing any <br /> such provisions. <br /> 63 <br />
