WITNESSETH <br /> WHEREAS, the undersigned GranLor (s) /Covenantor (s) is/are the <br /> owner (s) oL or has (have) a substantial interest in the real <br /> property legally describ�� above ("Property") ; and <br /> WHEREAS, Owner (s) applied to the City of Gverett for permi-ssion <br /> to constr�ct an accessory building that would be accessory Co <br /> single family use; and <br /> WHEREAS, Lhe Gr.antee/Covenantee, the City of Everett, ("City") <br /> has a substantial in'�erest in the safe and effective use of ] ands <br /> withi.n i.ts borders and in L-he healCh, safety and welfare of its <br /> citizens; and <br /> WHEREAS, the Planning Director tias the authority to allow <br /> detached accessory buildings to exceed fifteen feet in height, or <br /> to exceed one Lhousand square feeL- �ubject to the provisions of <br /> GMC 1.9. 7 . 020 (K) ; and <br /> WHEREAS, pursuant to EMC 19. 7 . 020 (K6M) , Lhe applicant made <br /> application t:o the City seeking the cur,struction of a detached <br /> accessory buildin3 to a single family iPsidei�ce that would exceed <br /> fiPteen feeC in height or one thousand squar.� feet; and <br /> WHEREAS, the City of Gverett Flearing Exami u' has approved said <br /> application subject to Lhe appli�:ant -.omplying with all <br /> conditions of approval and recording a :.oven3nt acceptable to the <br /> City AtL-orney' s Office per t-he provisions o.` 3MC 19.7 . 020 (K) (5) ; <br /> and <br /> WHEREAS, before the City will issue any permit or approval for <br /> the construction of a detached accessory building to a single <br /> family residence that would exceed fifteen feet in height �r <br /> exceed one thousand feet, this Covenant rnust be signed, <br /> acknowledged and recorded in the records of Snohomish County as a <br /> restrictive covenant, restricting use by placing conditions on <br /> t}�e permission to con�lruct said detached accessory building; and <br /> WHEREAS, this Covenant concerns the Grantor/Covenantor' s use, <br /> occupati.on, enjoyment, or development of the Property and <br /> benefits the City as Grantee/Covenantee.
