PLANNING DIRECTOR DETERMINATION <br /> Fence Modiflcatlon <br /> Review Proeess I q03-012 <br /> INTRODUCTION:The City of Everett Planning Department has received an application from <br /> John Forde Jr.,2223 Rockefeller Ave., Everett WA 98201, to retain an existing six-foot high <br /> wrought iron fence within the front yard setback. 3ection 39.070.A.1 of the Everett Zoning Code <br /> grants the Planning Director the ability to pem,it a fence to exceed the maximum allowable height <br /> of forty-two inches within the front setback, through ;teview Process I as described in the City's <br /> Local Project Review and Fmcedures Ordinance. <br /> BACKGROUND: Section 39.070.A.1 of the Everett Zoning Code states that the maximum height <br /> of fences located within the front yard setback shall not exceed fortydwo inches in height unless <br /> approved by the Planning Director using the rev!ew process described in the City's I_ocal Praject <br /> Review and Procedures Ordinance. <br /> ' The subject property is located at 2223 Rockefeller Avenue, in the R-2 Singte Family Residential <br /> Zone. The property owner has made application for a fence modification to retain a six-foot tall <br /> fence,which is located within the front yard setback. <br /> FINDINGS: The subject fence is a six-foot tall wrought iron fence which runs along the west side <br /> of the property. The nature of the fence is such that there is an allowance for the free flow of light <br /> and air, as well as clear visibil�ty of the residence. The fence appears to be located within the <br /> City of Everett right-af-way. The City of Everett Public Services/Engineering Departrnent has <br /> reviewed the proposed fence modification. <br /> DECISION: The PlanninQ Director has detertnir.ed to approve the application for the fence <br /> modification based on the foliowing conditions being met: <br /> • A City of Everett Public Worics pertnit is required for the portion of the fence located <br /> within the City right-of•way. <br /> • This approval is only for the portion of the fence which runs along the westem property <br /> line. Any new fence proposed to exceed the height limitations as established in Section <br /> 39 of the Zoning Code shall be approved by the Ciry prior to installation. <br /> This is an administrative decision that may be appealed to the City's Land U^s Hearing Examiner. <br /> An appeal must be filed with the City within 14 days of the date of this notice.
