BOARD OF ADJUSTMENT <br />FINDINCS� CONCLUSIONS AND ORDER <br />VARIANCE N0. 15-88 <br />Based upon the trritteu request for a variance from the City's zoning code by: <br />Bay Toau Eacrow, Inc. <br />Ed Medema <br />5017 Claremont Way <br />hereinafter referred to ae "Applicant," for a variance from EMC 19.40.010, <br />Off Street Parking, to provide 3 instead of the 6 off—etreet parking apacea <br />required by Code for an office use. <br />commonly kaovn as: 3226 Rockefeller <br />The Board of Adjuetment, following a public hearing oa eaid application held <br />on May 2, 1988 and further having reviewed all teatimony, makea the <br />follorring Findinge, Concluaione and Order: <br />VARIANCE CRITERIA: <br />Find:nga and Concluslone: <br />Criterion il: That there have been exceptional or extraordinary <br />circumatances or conditione applying to the aubject <br />property or ae to the intended use thereof that do not <br />apply generally to other propertiee in the same vicinity <br />or zone. <br />a. Finding: The Applicant ia propoeing to uee an exiating brick, <br />eingle family structure ae an office for an escrow company. <br />They would uee about 000 equare feet of the 1,140 aquare foo[ <br />etructure and there would be tvo employeea at the present time <br />Cthe ownera of Bay Towr. EacroW). There is normally only one <br />client.in the office at � clne with two heing there at one time <br />occaeionally. The majority of client vieits are under five <br />minutea. <br />The lot ie only 25 feet wlde and originally the Applicant had <br />propoaed putting three parking epacea in the front yard and <br />three off the alley; horrever, Public Worke would not allox <br />parkf.ng In the front oince there would be no room tu turn <br />around and vehicles would have to back out onto Rockefeller. <br />There ie an eaisting acceseory building in the rear yard that <br />will be demolished, as the Applicant is now proposing to <br />conatruct dix parking apaces in the rear yard; horrever, only <br />three of these could be cou¢ted towarde the parking <br />requirement, eince ehe cther three would be "stacked," i.e., <br />blocked from acceae to the alley by the three atalls direc�ly <br />adjacen[ to the alley (see Ezhibtt 3, Site Plan). Che <br />Applicant feels thc_c i`��e= "...-^w^a" ��?ces rould be used for <br />employee parking, leaving the three off the alley for clients. <br />
