31. The proposal is located at 1871 Ross Avenue, Everett, Washington. Because of <br />ils close proximity to the Snohomish River, a shoreline of significance in the <br />State of Washington, and because the proposed project exceeds the $5,000 <br />threshold construction amount, a Shoreline Permit is required. It is required for <br />the construction of lhe 12-foot by 26-foot equipment building and the cellular <br />anienna within a 150-foot tall ilagpole. (exhibit 2, Ervine testimony) <br />32. The zoning of the subject property has been identified above. The shoreline <br />designalion of the subject property is Urban, Mixed-Use Industrial. A cellular <br />antenna and equipment building are permitted uses in this shoreline designation. <br />(exhibit 2) <br />33. The Dagmar's Landing site is within Section 9 0( Township 29 N, Range 5 E, <br />W.M. (exl�ibit 2) <br />34. The subject property is considered a utility which is permitted in the Urban, <br />Mixed-Use Industrial shoreline designation. The Shoreline Permil requires that <br />the project comply with regulations in liie "Ulilities" chapter. These criteria <br />include: <br />Non-water-oriented ulilities facililies shall demonstrate that no options exist <br />before approval is granted for locatior� within shoreline areas, except for: <br />a. Expansion of existing facilities, induding lhe city's water pollution control <br />facility; <br />b. Utilities constructed in rights-of-way wilh existing facilities; <br />c. Ulilities necessary to serve developmenls permilted in shoreline <br />jurisdiction; <br />d. Sewer facililies necessary to iransport sewage to the water pollution <br />control facilily; and <br />e. Water transmission and distribution lines, natural gas lines, and electric <br />power lines, crossing the Snohomish River or other water bodies. <br />(Regulation #2, Page 5-59, Everetf Shoreline Master Prograrn) <br />35. Utilily installation in the shoreline area must be designed or inslalled io be <br />aeslhelicaily pleasing and not significantly impaci views of the shore�ine (see <br />Regulation #6, page 5-60, Everett Shoreline Master Program). The proposed <br />facility would be a flagpole. The Cily indicated that ihis complies �vith Regulation <br />#6 because it is designed to show palriotism for Everett, an Ail-American City. <br />The City has indicated thai the (lagpole should be limited to the display of the <br />(lag of governments or noncommercial insiitutions.
