area eliminates all possible economic uses. (exhibit 1, staff report; exhibit 7, <br />application; Jimerson testimony) <br />Pursuant to the State Environmental Policy Act (SEPA), the City of Everett was <br />designated as the lead agency responsible for the identification of all <br />envirc.nmental impacts resulting from the proposed project. On March 5, 2008, a <br />Final Mitigated Determination of Non -Significance (MDNS) was issued. The <br />appeal period for the MDNS expired on March 19, 2008, and no appeals were <br />filed. The threshold determination is final. (exhibit 1, staff report; exhibit 17, <br />checklist; exhibit 18 MDNS; Jimerson testimony) <br />The ESMP includes General Regulations that have been reviewed by the City of <br />Everett. The Applicant's proposal must satisfy the general regulations that are <br />set forth in Section 3 of the ESMP. (exhibit 1, staff report) <br />Exterior lighting would be directed downward onto the site and away from all <br />shoreline properties and nearby neighborhoods. The ad;oining properties are <br />industrial in nature and there are few, if any, residential structures in the area. <br />(Jimerson testimony) <br />The shoreline development is subject to the provisions of Everett Municipal Code <br />(EMC) Chapter 20.08 which includes noise standards within the City. While the <br />City may require the Applicant to prepare noise studies, it would be discretionary. <br />(exhibit 1, staff report) <br />10. Most, if not all, of the activity on -site would be industrial in nature. The Applicant <br />proposed !andscaping and mitigation plans in areas where the industrial activity <br />would not occur. These include shoreline restoration, landscaping and mitigation <br />along the parking lot, and perimeter landscaping. The City recommended that <br />the crane ways that are on the east and west ends of the proposed building be <br />screened. (exhibit 1, staff report) <br />11. Presently there does not appear to be any cultural resources that would be <br />endangered with the construction. However, if any historical artifacts or <br />archaeological findings of consequence are discovered, the Applicant is required <br />to immediately stop work and notify the City and the Tulalip Tribes. At that point <br />a professional archaeologist would be required to inspect and evaluate the site. <br />The cultural resource preservation is a recommended condition of the City of <br />Everett. (exhibit 1, staff report) <br />12. There are sorne flood fringe areas within the subject property. EMC 19.30.040C <br />requires that all structures be built at least two feet above the 100-year flood <br />elevation in flood fringe areas. This requirement is imposed as a condition of the <br />Shoreline Permit. (exhibit 1, staft report) <br />
