(exhibit 1, staff report; exhibit 7, application; Jimerson testimony) Pursuant to the State Environmental Policy Act (SEPA), the City of Everett was designated as the lead agency responsible for the identification of all envirc.nmental impacts resulting from the proposed project. On March 5, 2008, a Final Mitigated Determination of Non -Significance (MDNS) was issued. The appeal period for the MDNS expired on March 19, 2008, and no appeals were filed. The threshold determination is final. (exhibit 1, staff report; exhibit 17, checklist; exhibit 18 MDNS; Jimerson testimony) The ESMP includes General Regulations that have been reviewed by the City of Everett. The Applicant's proposal must satisfy the general regulations that are set forth in Section 3 of the ESMP. (exhibit 1, staff report) Exterior lighting would be directed downward onto the site and away from all shoreline properties and nearby neighborhoods. The ad;oining properties are industrial in nature and there are few, if any, residential structures in the area. (Jimerson testimony) The shoreline development is subject to the provisions of Everett Municipal Code (EMC) Chapter 20.08 which includes noise standards within the City. While the City may require the Applicant to prepare noise studies, it would be discretionary. (exhibit 1, staff report) 10. Most, if not all, of the activity on -site would be industrial in nature. The Applicant proposed !andscaping and mitigation plans in areas where the industrial activity would not occur. These include shoreline restoration, landscaping and mitigation along the parking lot, and perimeter landscaping. The City recommended that the crane ways that are on the east and west ends of the proposed building be screened. (exhibit 1, staff report) 11. Presently there does not appear to be any cultural resources that would be endangered with the construction. However, if any historical artifacts or archaeological findings of consequence are discovered, the Applicant is required to immediately stop work and notify the City and the Tulalip Tribes. At that point a professional archaeologist would be required to inspect and evaluate the site. The cultural resource preservation is a recommended condition of the City of Everett. (exhibit 1, staff report) 12. There are sorne flood fringe areas within the subject property. EMC 19.30.040C requires that all structures be built at least two feet above the 100-year flood elevation in flood fringe areas. This requirement is imposed as a condition of the Shoreline Permit.
